JUDGE HALVES JAIL SENTENCE FOR GARSTON MAN

A local trouble maker who breached his ASBO has had his jail term halved by a judge. The 27-year-old labourer, of Horseshoe Lane, was convicted of nine public order offences, which include affray and racially aggravated threatening behaviour, before being handed out an Anti Social Behaviour Order (ASBO) in June 2006. The order prevented him from causing harassment, alarm or distress to anyone outside his own household. However, in June last year (2007) the anti-social yob punched and kicked his ex-girlfriend after a drunken row broke out between the pair. He also threatened passers by who tried to intervene, before turning his aggressive attention to police officers called to the scene. In August last year, the Labourer was sentenced to 18 months in prison at St Albans Crown Court for breach of his ASBO and for common assault. This 18 month sentence though was halved last month by Lord Justice Longmore, Mr Justice Lloyd Jones and Sir Christopher Holland, who are all part of London’s Criminal Appeal Court. Lord Justice Longmore said that while the 27-year-old’s behaviour had made the streets unsafe, he allowed his appeal. He stated that there had to be more correlation between the sentence issued for the breach of ASBO and the offence which triggered it. The judge added that the maximum term for common assault is six months, and in the circumstances, 18 months was too long for the breach of ASBO.
